By downloading, installing, accessing, or using the Hush application ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the App and delete it from your device.
These Terms constitute a legally binding agreement between you and Efkan Works ("we," "us," "our," or "the Company"), a California-based entity.
Hush is a consumer software application that provides:
Hush is designed as a convenience tool and supplementary parenting aid. It is not a safety device, medical device, professional monitoring system, or substitute for any form of direct human supervision.
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS THAT DIRECTLY AFFECT YOUR SAFETY AND THE SAFETY OF YOUR CHILD.
HUSH IS A CONSUMER SOFTWARE APPLICATION. IT IS NOT A MEDICAL DEVICE, SAFETY DEVICE, CERTIFIED BABY MONITOR, VITAL SIGNS MONITOR, BREATHING MONITOR, EMERGENCY ALERT SYSTEM, OR ANY OTHER DEVICE SUBJECT TO REGULATORY APPROVAL OR CERTIFICATION. The App has not been tested, evaluated, cleared, approved, or certified by the FDA, any equivalent medical regulatory agency, the CPSC, or any other governmental or regulatory body.
THE APP IS NOT — AND MUST NEVER BE USED AS — A SUBSTITUTE FOR RESPONSIBLE, ATTENTIVE, DIRECT HUMAN SUPERVISION OF A BABY, CHILD, OR ANY PERSON. You must at all times ensure that a responsible, alert adult is within safe proximity to the child being monitored. The App is intended only as a supplementary convenience aid and must never be the sole or primary means by which you monitor, supervise, or ensure the well-being of any person.
The App uses probabilistic artificial intelligence (machine learning) to classify audio. AI-based sound classification is inherently imperfect and may fail at any time, for any reason, without warning. Specifically:
Parent Alert notifications depend on multiple technology layers, any of which may fail independently or simultaneously, including internet connectivity, push notification infrastructure (APNs/FCM), device state (battery, Do Not Disturb, airplane mode), operating system behavior, and inherent latency ranging from seconds to minutes.
The App runs on consumer electronic devices that are not designed or certified as safety monitoring equipment. Devices may run out of battery, overheat, experience hardware failures, or become unresponsive at any time. You are solely responsible for ensuring your device is adequately charged and functioning properly.
You are solely responsible for maintaining safe volume levels appropriate for infant hearing, ensuring proper distance between the speaker and the child, and following your pediatrician's guidelines regarding sound exposure. We make no representations that the sleep sounds provided are medically appropriate for any specific child or condition.
Nothing in the App, our website, marketing materials, or communications constitutes medical advice, diagnosis, or treatment. The App does not monitor vital signs, breathing patterns, blood oxygen levels, heart rate, temperature, or any physiological parameter. Always consult qualified healthcare professionals for any health concerns regarding your child. Follow all safe sleep guidelines recommended by the American Academy of Pediatrics (AAP) and your child's pediatrician.
THE APP IS NOT AN EMERGENCY RESPONSE SYSTEM. In any emergency, call your local emergency services (911 in the United States) immediately. Never rely on the App to detect or alert you to emergency situations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, ACCURACY OF CRY DETECTION, TIMELY DELIVERY OF NOTIFICATIONS, AND DEVICE COMPATIBILITY OR PERFORMANCE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EFKAN WORKS, ITS FOUNDERS, DEVELOPERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES ("THE HUSH PARTIES") BE LIABLE FOR ANY PERSONAL INJURY, BODILY HARM, DEATH, EMOTIONAL DISTRESS, PROPERTY DAMAGE, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE APP — INCLUDING ANY FAILURE TO DETECT CRYING OR DISTRESS, ANY MISSED OR DELAYED NOTIFICATION, ANY TECHNICAL FAILURE, ANY HARDWARE LIMITATION, OR ANY ACTION TAKEN IN RELIANCE ON THE APP — REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF, NOTWITHSTANDING THE FOREGOING, ANY LIABILITY IS FOUND, THE TOTAL AGGREGATE LIABILITY OF THE HUSH PARTIES SHALL NOT EXCEED THE GREATER OF: (a) THE AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (b) FIFTY UNITED STATES DOLLARS (USD $50.00).
By using Hush, you expressly acknowledge, understand, and voluntarily agree that:
Hush offers an optional account system using Sign in with Apple or Sign in with Google. Creating an account is not required to use the App's core features. You may delete your Hush account at any time through the App (Settings → Account → Delete Account). Account deletion is immediate and irreversible. Upon deletion, your authentication data, Family Group membership, and Firestore data are permanently removed. Any active subscription continues until its expiration — you must separately cancel it through your device's subscription settings.
Premium subscribers may share their subscription benefits through a Family Group, supporting up to 3 devices total. The Family Group Owner is solely responsible for managing group membership. Members acknowledge that their shared premium access depends entirely on the Owner's active premium subscription and may be revoked at any time. Invite codes are 6-character alphanumeric codes, valid for 24 hours, and intended for private family sharing only — public distribution or sale of invite codes is prohibited. We verify the Owner's subscription status periodically and revoke shared access if the subscription is no longer active.
Hush offers a free tier and premium subscription plans (Monthly, Yearly, and Lifetime). All payments are processed exclusively through the Apple App Store or Google Play Store — we do not have access to your credit card, bank account, or any payment details. Monthly and Yearly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Refunds are handled by Apple or Google according to their respective policies. We reserve the right to change subscription prices with reasonable notice. Lifetime purchases grant premium access for the operational life of the App — "Lifetime" refers to the lifetime of the product, not the lifetime of the purchaser.
You agree to indemnify, defend, and hold harmless Efkan Works, its founders, developers, officers, employees, agents, affiliates, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of or inability to use the App; your reliance on the App for child monitoring or supervision; your violation of these Terms; your violation of any applicable law; your negligence or willful misconduct; any claim by a third party related to your use of the App; or your failure to maintain adequate supervision of your child while using the App.
All content, features, and functionality of the App — including sound recordings, AI models, software code, design, text, graphics, logos, icons, and user interface elements — are the exclusive property of Efkan Works and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the App. You may not reverse-engineer or attempt to extract the source code of the App. "Hush," "Smart Nanny," "Velvet Rain," and associated logos are trademarks of Efkan Works.
You agree not to use the App for any unlawful purpose; interfere with the App's proper functioning; circumvent any subscription or paywall restrictions; publicly distribute or sell Family Premium Sharing invite codes; or use the App in any way that violates the terms of the Apple App Store or Google Play Store.
We reserve the right to terminate or suspend your access to the App at any time, without prior notice and without liability, for conduct that violates these Terms or is harmful to other users, us, or third parties. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3–6 (Safety, Warranties, Liability, Risk), Section 10 (Indemnification), and Section 11 (Intellectual Property).
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, government actions, war, labor disputes, utility or telecommunications failures, internet or network outages, third-party service provider failures (including Apple, Google, Firebase, or RevenueCat), or any other event beyond our reasonable control.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States. Before filing any formal legal action, you agree to first contact us at support@hush-baby.app and attempt to resolve the dispute informally for at least 30 days. If informal resolution fails, any dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in California. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Efkan Works regarding the use of the App and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify users through the App or our website. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
Our failure to enforce any provision of these Terms shall not be construed as a waiver of such provision or the right to enforce it at a later time.
